What is an EU Authorized Representative?

An “EU Authorized Representative” or “EU AR” in short, is any natural or legal person established within the European Union who has received a written mandate from a manufacturer (EU/non-EU) to act on its behalf in relation to specified tasks with regard to the manufacturer’s obligations under the relevant Union Harmonization legislation.

On 16 July 2021, regulation 2019/1020 come into force, thereby is applicable for all non-EU manufacturers. Non-EU Manufacturers shall appoint an EU Authorized representative prior to placing the product on the market.

AR shall be required for the products falling under the scope of the following directives:¹

• • 2006/42/EC – Machinery Directive

• • 2014/30/EU – Electromagnetic Compatibility Directive

• • 2014/35/EU – Low Voltage Directive

• • 2014/53/EU – Radio Equipment Directive

Upon appointment of an EU Authorized representative by a manufacturer, the mandate shall at least allow the following tasks:

• • Keep the EU declaration of conformity and the technical documentation (Technical File) at the disposal of national surveillance authorities and cooperate with them at their request,

• • Upon a reasoned request from a component national authority, provided that authority with all the information and documentation necessary to demonstrate the conformity of a product,

• • Cooperate with the competent national authorities, at their request, on any action taken to eliminate the risks posed by products covered by their mandate.

• • Affixing of the CE Marking (and where relevant other markings) and the notified body’s number to the product,

• • Draw up and sign the EU Declaration of conformity,

• • Keep track of changes in EU regulations/directives that may potentially affect manufacturer’s product conformity assessment,
